Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Lumi mobile application (“App”) and associated services provided by Danukz (“Company,” “we,” “us,” or “our”), based in Italy.

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the App.

1. Use of the App

1.1 Eligibility

You must be at least 13 years old, or the legal age of majority in your jurisdiction, to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

1.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and applicable laws.

2. User Accounts

Some features of the App require account registration (e.g., data sync, caregiver sharing). You agree to:

Provide accurate, complete, and current information
Maintain the confidentiality of your login credentials
Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate your account if we suspect unauthorized use or violation of these Terms.

3. Subscriptions and Payments

Certain features of the App are available only to subscribers of Lumi Premium. If you choose to subscribe:

Subscription Plans are billed through the Apple App Store or Google Play Store, depending on your device. The subscription is offered on a recurring basis (e.g., monthly or annually), and will automatically renew unless canceled at least 24 hours before the end of the current billing period.
You are responsible for managing and canceling your subscription through your respective app store account settings.
Free Trial: We may offer a one-time free trial period for new users to try Lumi Premium. The free trial is only available once per Apple ID or Google account. At the end of the free trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

All payments, billing, cancellations, and refund requests are handled directly by the App Store or Google Play. We do not process or issue refunds ourselves.

4. User Content

You may submit content such as baby activity logs, notes, photo and video attachments (“User Content”). You retain ownership of your content, but you grant us a worldwide, royalty-free, non-exclusive license to use, store, host, and process it solely for the purpose of providing and improving the App.

You agree not to upload content that is illegal, harmful, abusive, or infringing on others’ rights. We reserve the right to remove any content that violates these Terms.

5. Data and Privacy

By using the App, you agree to the collection and use of information as described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

6. Intellectual Property

All intellectual property rights in the App, including but not limited to its design, features, graphics, logos, and source code, are owned by or licensed to Danukz. Except for the limited license granted in Section 1.2, nothing in these Terms grants you rights to our intellectual property.

7. Prohibited Conduct

You agree not to use the App for any unlawful purpose, reverse engineer or tamper with the App, or attempt to gain unauthorized access to systems or user accounts.

8. Termination

We may suspend or terminate your access to the App at any time, without notice, if you breach these Terms or if your use poses a legal or security risk. Upon termination, your right to use the App ends immediately.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind. The App is intended for informational purposes only and does NOT constitute medical advice. Always consult a qualified healthcare provider for any medical concerns.

We do not guarantee that the App will be error-free or that translations (some of which may use AI) are perfect.

10. Limitation of Liability

To the fullest extent permitted by law, Danukz and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App.

11. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after such changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of Italy. If any dispute arises, the parties shall first attempt to resolve the matter amicably before submitting to the competent courts in Italy.
